You may be eligible to receive money from an employee class action lawsuit against Morrow-Meadows Corporation for alleged wage and hour violations. The Action combines two lawsuits: one was filed by former employees Marie Pacheco and Rafael Robinson, and the other was filed by former employee Araceli Noriega (collectively, the "Plaintiffs"). The Plaintiffs are seeking (a) back wages, penalties, interest, costs, and attorneys' fees for hourly employees who worked for the Company in California for any amount of time from August 5, 2011 to February 28, 2018 (the "Class Members"), and (b) civil penalties under the California Private Attorneys General Act ("PAGA") for hour employees who worked for the Company for any amount of time between August 10, 2014 and February 28, 2018 (the "Aggrieved Employees").
The proposed Settlement has two main parts: (1) a Class Settlement requiring the Company to pay Individual Class Payments to each participating Class Member, and (2) a PAGA Settlement requiring the Company to pay Individual PAGA Payments to the Aggrieved Employees and to the California Labor and Workforce Development Agency ("LWDA").
You have two basic options:
(1) Do Nothing. You do not have to do anything to participate in the proposed Settlement and be eligible for an Individual Class Payment and/or an Individual PAGA Payment.
(2) Opt Out of the Class Settlement. You can exclude yourself from the Class Settlement (opt out) by submitting a written Request for Exclusion or otherwise notifying the Administrator in writing. If you opt out of the Class Settlement, you will not receive an Individual Class Payment. You will, however, preserve your right to personally pursue Class Period wage claims against the Company, and, if you are an Aggrieved Employee, remain eligible for an Individual PAGA Payment. You cannot opt out of the PAGA Settlement.
